I considered this route, but decided against it as I didn't want to rub the taxman up the wrong way!
They aren't stupid, and if they find out you are running a commercial D4 with a seat conversion, I was worried that they would find every reason under the sun to say it was now not a commercial vehicle.
I decided to stay safe and bought the D4 HSE and fully declare it and pay the associated benefit which is 35% of the list price gross, ie 35% x £52000 = £18200 x 40% = £7280 per annum (£606.00 per month)
I pay my own private fuel, so I don't need to pay fuel benefit, and I charge my company 19p per mile whenever I use the car on business.
I just think that trying to work your way round loopholes can often be like waving a red rag at a bull so far as HMRC is concerned, so I would rather pay my dues and know that I'm safe!
Also I still reckon its pretty good value to be honest! For £606.00 per month, I'm driving a brand new Disco 4, and my company takes the depreciation hit and covers all the bills ie tyres, tax, servicing, insurance etc....
OK, I know that a commercial vehicle would attract a BIK fixed cost of £3000 gross x 40% = £1200.00 (£100 per month) but I just wouldn't be happy trying to justify a Disco 4 Commercial with rear seats fitted if ever I was in an investigation situation!

hmmmm. Thats the Dilema I find myself in. I am not wanting to "fiddle" any tax. I currently have a Navara which I use for business, and as it has seats in the back, I can use for family camping trips and stuff at weekends.
The thing is I do quite high mileage and the Discovery is 1) a lot more comfortable 2) a lot better on Fuel economy.
During the week, with the seats down, a perfect work horse for me..at the weekends, put the seats up and the kids can come out with me.
I cannot afford the personal tax if its classified as a car...and the last thing I want to do is be clobbered with back tax if I go ahead with it, then find out the Tax man wont allow it.
I think probably the best thing is to get my accountants to check with the tax man and get it all cleared up.
if tax man says no, then navara stays...

My Navara V6 does on a very good run 24.5mpg
According to other people who have the new Dicovery 4, they can get on a good run 30mpg
I do 35k plus miles per annum, so it could be quite a saving on fuel.

A good pal of mine bought a 2500cc diesel navara a few months ago. Its a lovely vehicle! Leather, satnav,cruise--all the goodies.
We actually went to London in it a few weeks ago, and to be honest I thought it was great!
I,ve got an old shaped Navara on my company books, and its agricultural! but the new model is so much more refined!
If it was me, I would keep or update the navara to be safe.
You could check with your local HMRC, but that could be opening a can of worms!
Why not keep or update your Navara to be safe? You can buy a new one for about 22k plus VAT....

we only get about 24mpg out of the Disco 4 !
Just done a run to Salzburg and back on a ski-ing trip and the average on the computer when we got back was 24.7 MPG.
That was mostly motorway work at about 80mph, with a roofbox and full load....

Your right, the Navara is pretty well equiped.
I have the V6 oulaw, 1 yr old, which has everything the Discovery has
Leather, Sat Nav, DVD player, Auto, Cruise, Sunroof,
But it is no where near as comfortable or relaxing to drive on long motorway trips, hence the reason for wanting to change.

Im new to the forum but have been researching this for a while.

I was aware of the restriction on single carriage ways but not that there was something that overrode that. Can someone please explain how that works?

yer need to read his post again, he was reffering to when he was towing a trailer due to space in the rear of a d3 against a van which then didnt need a trailer and thus could drive at higher speeds on an A road
