NEED YER D4 COMMERCIAL ON A WEIGH BRIDGE

Ok guys, given the recent update to the new towing legislation and the definition of a DPV (Dual Purpose Vehicle) being exempt from an O-Licence, we need a few guinea pigs to best understand where the current D4 Commercial might fit.

What we're hoping for is some kind souls to have thier vehicle weighed at their nearest VOSA Approved Public weighbridge.

This needs to be the "unladened" weight ie with 90% fuel (the 75kg for the driver can be then added to the calcualtions after) and nowt else.

IDEALLY we're looking for

a) A STANDARD D4 COMMERCIAL WITH SPARE WHEEL FITTED AND WITHOUT SPARE WHEEL

b) A STANDARD D4 COMMERCIAL WITH NON-APPROVED REAR SEATS AGAIN WITH AND WITHOUT SPARE WHEEL

c) A STANDARD D4 COMMERCIAL WITH APRROVED AFTERMARKET REAR SEATS YET AGAIN WITH AND WITHOUT SPARE WHEEL AND

Can anyone assist in this experiement to better understand what might be poss under the new legislation Thumbs Up

cheers for that, I'm going to weigh my TDV6 5 seater as soon as I can find a bleedin public weight bridge open.

Remember, needs to have 90% fuel in it and nowt else, if yer could step out of the car and we'll add the EU 75kg on top of yer weight Thumbs Up

I'll see what I can do as my Commercial has non-LR seats fitted by Atlantech... these are deemed to be van conversion seats and therefore retain the commercial element.

I should be into one of our client sites at some stage in the first couple of weeks in the New Year - will this be time enough? The sites would be a Council operated weighbridge... hope I can get a print out of the two options...

Let me know if this works timewise...

ps think about it, compares to a normal disco its going to be lighter as its minus 5 seats, betls etc. So what we are talking about is window tax. If you have blacked windows you suddenly cant to 3.5tons if you can see through the rear windows then your fine. Total joke really. We've had the same debate of the defender forum and it boild down to a window tax.

what I trying to demonstrate to VOSA/DoT is that the manufacturer figures are a guide against the actual fully built vehicle and that the manufacturer will often put the same figure down on the V5C/Vehicle Plate as its passenger going version of that model as in the case of a D3/D4 Commercial vehicle.

In turn I want to add these illustrations along with a considerable amount of other evidence to persuade ministers and other stakeholders that the regs should fall within a band of x to x as oppose to the hard and fast rule of 2040kg for dual purpose vehicles when it comes to O licences.

Already we have found that none of the current Defenders with more than one passenger seat (in order to comply a DPV must be for carrying "goods and PASSENGERS") do infact weigh " less than 2040kg kerbweight" and the only ones that do, do not have seats for more than one passenger and thus not a DPV Shocked

That's not how I read it.

Is the 90 under 2040kg unladen : yes

Is the 90 4wd : yes

Does the 90 have a passenger seat : yes

Duel purpose vehicle requirement met. It's also a car derived van for speed limit purposes.

Again the only difference is glass. It's a joke. Vosa are on a loser if they think they are going to take all land rovers out of the car derived van and dual purpose vehicle legislation. That's not what the law says.

If they think they can convince a judge, who is the only person who can sort it, that your 2.7 ton disco with blanked windows is suddenly not a duv or car derived van because of the 2ton limit in the legislation then good luck to them. The spirit of the law says to me it doesn't intend to treat cars and specifically 4x4's the same as a proper van or non-dual use vehicle. Until one goes to court to sort it I can't see how they can enforce it. Just tell them to foxtrot Oscar!

Read page 5 for the exemptions and it specifically states landrovers and their trailers are exempt!

Worry no more common sense has prevailed, the window tax would have defeated them anyway otherwise tin tents would all need an operator licence as well!

I gathered that bit but thought I'd read somewhere that Dual Use Vehicles had to carry more than 1 passenger? If that is the case a commercial will be excluded.
