the turbo oil feed pipe and drain pipe are on the passenger side

Sounds like some body has not used a torque wrench to tighten the filter cap and stripped the threads, the bottom pipe on the oil filter must be fitted into the hole in the bottom of the oil filter case.It can when others can't,

Was it a trade only auction? How was it described- ie were all material facts declared?
If non trade, does the 14 day cooling off internet buyibg period apply?

the car was put in by webuyanycar, so there is a chance that it was the person that put it into them that knew as WBAC put hundreds through so might not have known.
trouble is the auction hall is over 100 miles away from me and i will have to declare the oil leak problem otherwise i will be just as bad if not worse for stitching someone else up.

it was serviced 10/11/2017 7k miles ago, if it was overtightened and threads stripped, would it take that long to let go? the oil filter didnt feel loose when i tried to turn it from the top.
admittedly i didnt get above it to see down the side to see if it was wet at the base, but i would have thought that there would have been some splashes of oil around the top would there not?

regardless of who was actually selling the car, with an oil leak of the magnitude you have described, neither WBAC or the auction house (BCA actually own WBAC) could have failed to see the resultant oil slick. Even auction houses have to disclose material facts and accurately describe the cars that they sell.

It was a sold as seen advert and the only thing it said was the Dash Warning Light on -EML.
the funny thing is when i went to the car the EML light was not on.
When i questioned BCA i discovered that it had been through before and that the reason i beleive it never made reserve was because people could physically see oil dripping from it when it went through the ring.
I stated that either the auctioneer, driver or another member of staff must have known there was a leak and therefore they should have noted it the second time it went through.
this is why i believe they advertised it with the EML on to cover their arses.
They said the vendor offered me £250 of as full and final settlement, this figure takes it back to the reserve it started at in the auction. i bid first then hall bidders which i now believe was BCA them selves pushing the price up as i wasnt there in person.
BCA knew full well it had an oil leak but how do you prove that?
if it is just a a filter and housing then all well and good, the thing im worried about is how long has it been driven with no oil and what other damage will it have done once the leak is fixed and its run up to temperature?
Dont get me wrong, when i put the oil in initially it sounded sweet so hopefully it will be ok.
ive learnt a valuable lesson, dont buy from auction unless you are physically there.

interesting, i never knew that BCA own WBAC ! i agree, the oil leak could not be missed by either of the above. im gonna get them on the phone tomorrow.
i opened up a trade account and this is my first purchase ! not a good start for a business relationship even though i was buying this for myself

yes but did you buy it as a trade to trade sale or as a private individual? I'm guessing that you bought as trade as I don't believe that a private buyer can bid online at a BCA auction? In that case the story probably ends.
If however you were buying it as a private individual, becuase you were buying from a trade seller, then you should have a case as a trader cannot legally sell something mis-described or not fit for purpose - ie. sold as seen holds no legal water.
So in summary,
trader sells to trader = no come back
private vendor sells to private vendor = limited or no comeback
trader sells to private buyer = statutory rights apply under The Sale of Goods and Services Act, and possibly the Distance Selling Regs.
I don't suppose you paid by credit card? If so the CC company maybe able to apply some leverage.
I'm not a lawyer, find one quickly or even talk to trading standards for qualified adviceNot such a Disco Newbie now!
