Ensure that all comminication by post is recorded or signed for delivery. Do not release ANY original documents only copies. Keep a diary as an aide memoir to progress.
Is the garage a member of motor traders assoc or other national body, have they plush trading premises, how embarrassed are they likely to be if you eventually 'go public'.
Nothing focuses attention more than lost profit (from other lost sales)
Get as much background on them and the MOT station if separate.
Be careful not to overstep the mark and become a harassment to them as unfortunately you may then be infringing the law.
Do not stray from fact, always stay calm.
Ultimately if they do offer an acceptable solution, get it in writing and if appropriate with a timescale, and not including the 'without prejudice' from them.

Maybe worth while looking into hosting your own website so if it doesnt go to plan when people search for the company concerned your site will come up.
It certainly works as wife wanted a car 18mths or so back and said she had seen some at big motoring world, quick search oh deary me not one good word to be found!
Keep it factual and I cant see how anyone can sue you etc as if its all true and documented you can prove your side of the story to anyone.
Also worth giving them the link to this thread as once their name appears in it again will come up in search results.

Watching with interest as I live in Bradford and am pretty sure I know who this dealer might be (from past experience). Obviously don't' name them but once it's all in the open I'd be interested to know who it is.

Do not believe that for one minute, I posted a factual story (which DM is referring to below this original post) about my treatment by a LR dealer. Both I and this forum (Martin) had heavy legal letters with threats of legal action by the most aggresive Glasgow Lawyer firm, I couldn't afford to play chicken with them.
Bottom line was, I was out of pocket by around £10K at the end of the day. I think it will end up being dependent upon firstly how the dealer reacts and if that is bad, then how deep your pockets are and how much you can afford to risk! You need to have a contingency plan, how much to put it right against how much may you lose if you fight.
Whatever you do, DO NOT NAME AND SHAME, it backfired big time on me and can give them the edge, even though true. Whilst you may be entirely correct it may end up with who has the deepest pockets. Joined the BMWX5 45e group

The business was an established dealer and a 4x4 "specialist" (in the loosest of terms)....
Does anyone have any advice on answering 'unknown numbers'? I dont want to make this a long process but would like to keep everything documented. Should I just await a written response? 2016 D4 Landmark

I'd want an audit trail of all letters etc, so wouldnt entertain anything said on the phone. It can be denied later Man with no D3 anymore, but cant leave the forum....how sad.

Hope it all works out, a lot of second hand car places just HPi check and valet the cars they buy then stick them on the forecourt. Not necessarily aiming to deceive buyers, more a case of volume sales and turnover and wanting to keep their costs down. Not condoning it, just saying!!
You might be pleasantly surprised, they may have been blissfully unaware of these issues.

If you answer the phone make sure you tell them clearly that the call is recorded and being transcribed once you have asked for their name and position in the company. (tell them before that and they may suddenly have a name change)
Record the call completely and then afterwards transcribe the whole thing - make sure there are two copies and they get one sent to them, again recorded.
That way at least you have a clearly diarised account of all events and they can't claim you were avoiding them when they were trying to help.
Obviously also keep the voice recordings and if the machine time and date stamps, even better. MY15 DIY Black Pack (Better than factory and half the price!)

Drive through their forecourt windows and say you couldn't stop due it being not fit for the road, make sure you hit as many for sale cars as possible. IID PRO
