4.4 V8: Lost Communication with Transmission Control Module |

Hi guys
I have a US spec 4.4 V8 LR3 with 180k miles on it. Sold engine and transmission always. Recently experience some weird issues of transmission, so looking to get some help here.
Symptoms:
Recently after I drive the car for more than 5 minutes and put it into P, it then wouldn't shift back to R or D. 5 seconds later, dash showed an E in transmission error and parking brake error. No EAS or other error was shown.
I have to turn off the engine, wait for 5 minutes and turn it back on again, and it would return to normal. Or if I unplug the battery and reconnect it it would be back to normal as well. However, the next cycle I put it into drive and then P, it wouldn't return to Drive again.
This doesn't happen when the car is cold, or at least every morning i back it out of the parking and change to Drive it works fine.

Background on the car:
Interstate Battery 3 years old, well taken care of, soft charged to full every half year.
New negative battery cable 2 years ago
Transmission flushed with correct fluid 3 years ago, leaking sleeve replaced
Transmission cable checked no rust and adjusted
New transfer case ECU (behind the battery) placed 2 years ago. It was water damaged before. i checked the new one recently, seems to be all dry
Brake switch changed 3 years ago
Taillight bulbs all fine
Checked all fuses related to transmission and transfer box, all seemed to be fine
No evidence of center console water damage
both side of sunroof rubber drain was replaced (had to remove the CJB for the passenger side, didn't notice visible water damage)
New starter 2 years ago
New alternator 3 years ago
Suspection
I think this is something electrical not mechanical because if i restart the car it shifts normal and the gears shifts normal as well.
Some harness or wire getting rusted? (where do you think I should check)
Ground points got rusted?
The transfer case ECU harness rusted?
Sorry for the lengthy post. I couldn't think of anything else, running out of ideas. Any suggestion would be helpful!

To me it sounds mechanical or brake light switch as to select a gear you need to press the brake pedal

Update:
I replaced the shifter and another brake switch. problems still exists.
Also noticed sometime when taking off at a greenlight the transmission doesn't want to shift till 3-4 seconds later, it was like a slip and then the gear punches in and suddenly have a push.
Any idea?

Second issue
I would check for low fluid.
Needs checking with engine running
