RE Court summons

I reccomend the Small claims Court... yes they would like written evidence BUT a verbal contract IS STILL a contract and the Dist recorder will look at it in that light and decide "on the ballance of probibility" who is telling the truth........

Also remeber as the company is a Ltd. Co IT has an obligation to attend court to justify its actions..... thereby costing it MONEY!!

ie.
Soicitor l for the hearing £500...
Pre court evidence bundle and counter claim £250
Ltd Co staff & time dealing with same £200


and the chance of loosing anyway and having your claim to still pay!

as you can see it WILL soon start to cost the Ltd Co MONEY....... they may take the decision thats its far better and CHEAPER to come round to dealing amicably with it.....

I recently had a problem with a large Company .
their sales rep was useless and did not deal with matters, many on going probs...

in final frustration I wrote to the Directors and detailed the problems and advised them that if it was not possible to settle this then Court action would seem the only other option but that clearly I did not wish to be forced into takeing that route.

In three days of writing (and sending it recorded delivery) I received a Personal tel call from the Chief excecutive (not his secreatry or an underling!)

He listend to the comments I had to make apologised that it had not been resolved and assured me that HE would personaly deal with it HIMSELF...

True to his word he did just that...within 48 hours the matter was settlted....


Bad publicity ADDITIONAL costs and court action are NOT in any companies interst..so I still think if I were you...Small Claims Court would be my next point of call

thanks for all the advice and help.I think I will just chalk this upto experiance.I have been 7yrs with court hearings and if I see another it will be too soon.
I take on bourd that there are always two sides to a story and Mr lamb has no way of responding to my rants but airing my laundry in pubic is a bit strong.I am just telling a tale with a moral.Get things in writing is what I am saying plus getting the anger out of my system.I am letting people know that if you take your beloved to Gordon lamb,the staff are great,service is great but watch out for the man upstairs in his ivory tower because he will try to charge you £350 for a car wash.
I got my bill reduced by 50% but it should have been100%
