Fuel Tank Breather ruptured

In May this year I filled up my Disco 3 with diesel only to have a flood on the forecourt when the level reached the top. Investigation showed that the air breather (a plastic fitting, "L" shaped on top of the tank, had its corner rubbed off, leaving ragged edges. New tank fitted and LR paid 75% of cost (car out of guarantee). Today the same thing happened again. It looks as if there is an in-built flaw in the Disco 3 or there is something amiss in mine when the tank is raised up into position. Being diesel the consequences on the forecourt are not disastrous but if it had been petrol things could have been totally different - especially as I was filling up next to a tanker which was replenishing the tanks! Anybody had similar experience? If anybody interested have photos of the fault.

Not a common issue, but please post photo's for reference. I would take it back even if it is out of warranty, something is certainly not right.
