Ok so by now you all know my D3 has proven to be less than reliable and despite this i still love and want to keep running it.

Having said that I have just finished editing my second formal complaint to LR. I have given them 20 weeks since the first letter to my dealer and coppied to LR in which to respond. The response has been less than Id hoped so now I have decided enough is enough and I am going directly to LR to request action and a replacement.

Im amazed, but I have had 45 faults since purchase 11 of which have been resolved and of those 6 were resolved by the update. The rest are in the main ongoing with a couple being concerns.

So..... fingers crossed they will be responsive as I hope.

I plan on sending to Dirctor of Customer services and cc Dealer and customer services rep who I have talked to about issues recently.

Any advice on key phrases I should use legal or otherwise?

Know any good solicitors who have experience in this area if I dont get an acceptable way forward?

When you spend the amount of time I do in the vehicle and have purchased what you were sold as a prestige vehicle when faults happen you notice them and want them putting right. perhaps having a hse with all the gadgets some will say you should expect more problems than those with a simple S spec, but I cannot accept that a higher spec and cost vehicle should be expctd to experience the level of failures I have. If we were talking about a couple of failures then I could live with them taking time to resolve, but 45? and 2 years on still trying to fix? Crying or Very sad

fingers crossed LR will exceed my expectations and TIA for any constructive advice.

oh and I should say I have a number of the 'non existent faults' on video or recorded. Im not crazy honest Twisted Evil Laughing Wink

Good luck mate. If they won't help then I guess you need to weigh up your legal options or go public.

Patient you appear to have been if its 2 yrs and still no resolve.

just shows I like the D3 at heart Wink but its the end of the road now for resolving the problems the normal way im afraid.

I know you get people come on here slagging the D3 off, and I hope Im not seen like that, but its hard to be positive when its been going on for as long as this.

hey... we understand Smile its just those people who come on and rubbish the D3 with no justification, proof and argue with no logic... and then disappear,

We've had far too many of these recently and its made many members a tad wary.

i remember a disgruntled disco 2 owner had some banners made up and took up residence outside lancasters reading Shocked he was not a happy owner to put it mildly... dont know if it done him any good though Laughing

Good Luck mate, hope they listen this time. Don't know of any solicitors, but I think maybe have a shortish consultation with one (may not cost much if anything for an initial chat to see how the land lies so to speak.)Who knows, any of us may have to head the same way one day. I know its hard to despise a D3, but I agree you have been more than patient with L/R and dealership to date.

Laughing thanks... good advice. Trading standards would be interesting. As for wasting money well Ive bought a D3 ... so a couple of quid on a solicitor is a pittance in comparison Laughing

following visit to trading standards website I have added following to my letter :

The Sale of Goods Act 1979 (as amended) requires you to supply goods of satisfactory quality. In addition the goods should be ‘fit for purpose’ i.e. do everything as documented and everything I am told at the time of sale it can do. This is clearly not the case. I have allowed a reasonable amount of time for the faults to be rectified and have suffered considerable loss and expense during this time pursuing resolution. Allowing time for faults to be rectified does not effect my right to reject the goods should the faults not be rectified. Due to the faults I have detailed below and the time I have allowed for rectification, I consider you to be in breach of contract. I hereby reject the item as it is not of satisfactory quality and respectfully request either a refund of the full purchase price from you or a working and fault free replacement.


Seems that is my rights. Confused

Bon chance.

The weakness in your position, as relates to the Sale of Goods Act, is that you have continued to have use of, and make use of, the vehicle for an extended period of time.

For that reason, even if you succeeded in bringing an action against the dealer, you would not be awarded a full refund.

Further, you have no contractual relationship with Land Rover and, as such, sending them a letter in the form you suggest will not help your case as regards "rejection", as you will have sent it to a third-party.

I'd give some serious further thought to what you plan to send and what you aim to achieve if I was you.
